We understand that the security of your personal and health information is important to you. We also understand that our continued success as a leading Health Information Technology company relies on our ability to communicate with you in a secure manner.

 

We adhere to the highest standards of decency, fairness and integrity in our operations. On the Internet, we take a number of measures to authenticate your identity when you access our services. We also take steps to protect your information as it traverses the Internet to and from your mobile device. We take steps to make sure all information is as secure as possible against unauthorized access and use. We also review our security measures periodically. Despite our best efforts, and the best efforts of other firms, “perfect security” does not exist on the Internet, or anywhere else.

Please read these Terms carefully. You may use RxWallet® only if you accept and comply with them.

These terms and conditions (collectively, the "Terms") constitute a legal agreement between you and RxEOB.Com, LLC (RxEOB®) and its affiliates, ("us", "our" or "we"). In order to use the RxEOB® and the associated RxWallet® App you must agree to these Terms. These Terms include our Privacy Policy, which is incorporated herein by reference.

If you do not wish to be bound by these Terms, you may choose to not access or use RxWallet®.

 

Use Means Acceptance

By using RxWallet®, you have agreed to all terms, conditions, and notices contained or referenced in these Terms.  These Terms include our Privacy Policy, which is incorporated herein by reference. All changes to the Terms, applicable law, and any posted guidelines and rules on the site are incorporated into the Terms and take effect immediately.  We may update these Terms at any time and may notify you of such updates by any reasonable means, including by posting a notice of the updated Terms to the Website or App. If you have not visited us recently, you should review the Terms for any changes since your last visit, but the new/amended Terms, etc., are effective whether or not you notice, or know about, a change. If you use RxEOB® after we make or post any changes to the Terms, you are considered to have accepted the changes.

 

Education Only

RxWallet® provides information prescription drug benefits and pricing to help you to make informed decisions about your prescription drug choices. We do not offer professional medical evaluation, advice, diagnosis, or treatment. Do not report any medical condition, e.g., your physical reaction to medication, to us. We cannot be responsible, and therefore you are responsible for reporting any reactions to any of the prescribed medications you are taking to your prescribing doctor, health authority, or emergency caregiver. IF YOU HAVE A MEDICAL EMERGENCY, CALL 911 OR GO TO A HOSPITAL EMERGENCY ROOM FOR MEDICAL ATTENTION. You should not rely on information received through RxEOB® for important personal, medical, or legal decisions. We strongly recommend that you see your own doctor or other health care provider for evaluation, advice, diagnosis, treatment, and to address any symptom or medical condition.

Changes to the Service

RxEOB® and its suppliers and vendors may change or modify the information, services, products, materials, and any other resources contained on or accessible through the Service, or discontinue the Service altogether, at any time without notice.

Limited License

Pursuant to an agreement with the provider of your prescription drug benefits (e.g. your pharmacy benefit plan sponsor), we grant you the right to access and use RxWallet® for your personal, non-commercial use and always subject to these Terms of Use which may be modified from time to time. You may download and print a copy of the information we provide in RxWallet®, but only for your personal, non-commercial use and only if you maintain any proprietary notices without modification. You may not reprint, copy, display, distribute, publish, or transmit any file, document, or graphic in whole or in part for any other purpose without the prior written permission of RxEOB®. You may not use or retrieve any of RxEOB®'s Content (defined below) to create or compile another Website, database, collection, etc. Unless RxEOB® expressly authorizes you to do so, you may not (whether in whole or in part) modify, rent, loan, sell, distribute or create derivative works based on RxEOB® or the software used in connection with RxEOB®. You may not reproduce, duplicate, copy, sell, resell or exploit for any purposes, any portion of RxEOB®.

 

Disclaimer

While RxEOB® believes that the information we provide through this RxWallet® application is current and reliable, because of the vast amount of pharmaceutical medical information, rapid advances in knowledge, and your particular physiology, we cannot and do not guarantee the accuracy of any information we provide. Further, all cost estimates, such as retail price estimates, discount prices and co-payment estimates, are provided for your convenience only and we cannot and do not guarantee the accuracy thereof.  You should never disregard medical advice or delay seeking it because of information from RxWallet®. The information contained in RxWallet® is compiled from a variety of sources ("Information Providers"), and neither we nor Information Providers directly or indirectly practice medicine or offer medical services as part of RxEOB®. The RxWallet® is NOT a health insurance policy and is not intended as a substitute for health insurance.

 

We will not be liable to you for your reliance on or use of any information and services obtained through RxWallet®. Also, we assume no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings. We and Information Providers cannot and do not warrant against human and machine errors, omissions, delays, interruptions or losses (including loss of data), or that files available for downloading will be free of infection by viruses, worms, or other harmful code.

 

LIMITATION OF LIABILITY

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT WE, INFORMATION PROVIDERS, AND OUR RESPECTIVE EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR OTHER DAMAGES, INCLUDING (WITHOUT LIMITATION) LOST PROFITS, GOODWILL, USE, DATA, OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM: (A) THE USE OR INABILITY TO USE RxEOB®; (B) ANY OTHER MATTER RELATING TO USE OF RxEOB®. YOU ACKNOWLEDGE THAT ALL THE LIMITATIONS OF LIABILITY AND THE RESTRICTIONS ON YOU IN THESE TERMS ARE REASONABLE GIVEN THE PROPOSED AND PERCEIVED BENEFITS OF RxEOB®, AND, TO THE FULLEST EXTENT PERMITTED BY LAW, YOU HEREBY RELEASE AND FOREVER WAIVE ALL CLAIMS YOU MAY HAVE AGAINST RxEOB® INFORMATION PROVIDERS, AND OUR RESPECTIVE EMPLOYEES, AGENTS, AND CONTRACTORS, INCLUDING, WITHOUT LIMITATION, CLAIMS BASED ON THE NEGLIGENCE OF ANY OF THE FOREGOING.

EXCLUSIONS AND LIMITATIONS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF WARRANTIES FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. THEREFORE, SOME THE LIMITATIONS IN THIS SECTION MAY NOT APPLY TO YOU.

Authentication

We use different pieces of information, collectively known as access codes, to properly identify and authenticate you before allowing you secure access to your member information. The first piece of information is your name and date of birth that is matched to eligibility information along with the member number from the ID Card provided to you by your plan sponsor.

 

Another piece of information is your Person Code, a code that is unique to you. Once you have successfully completed the registration process, You will be asked to create a UserID and password. You need to save your UserID and password.  Also, you will be asked to designate a pathway to receive a Multi-Factor Authentication token (MFA).  Use of the MFA token will provide additional security to ensure application access is being done by you.

 

For further security, you may be prompted to change your password from time to time to a password that you choose and meets the minimum criteria for application access. These will be stored on an encrypted database that is isolated from the Internet.  You are solely responsible for controlling your Login Information and for authorizing, monitoring and controlling access to your account. You agree to notify us immediately of any unauthorized use of your Login Information or of any need to deactivate the Login Information associated with your account. 

 

Data Traversing the Internet

Our site uses the highest levels of Internet security. We require the use of a secure browser and use its features such as data encryption, Secure Sockets Layer (SSL) protocol, usernames and passwords, and other tools. The system encrypts the login information and personal information that flows back and forth between you and us.

 

Encryption is the process of scrambling the information so that it can only be reassembled by the intended recipient- someone recording the communication will not be able to decipher the information. We use 256 bits for this encryption- the standard for our industry and the financial industry- making it virtually impossible for anyone else to read it. You can tell when you are on a secure page by looking at the URL (location or address field in the browser). If it begins with “https://” rather than “http://” the page is secure.

 

Digital Certificate

You can tell whether you are truly connected to us by viewing our digital certificate. The certificate verifies the connection between our public key and our server’s identification. Cryptography using digital signatures ensures you can trust the information within the certification. Your browser looks at it and trusts it.

 

Logout and our Timeout Feature

We make use of a secure login and advise you to log out of our site as soon as you are finished with your access. We also use a timeout feature to protect you further. After an extended period of inactivity at our site, we will log you out automatically.

 

Data Within our Walls

The personal information our site collects is stored in secure operating environments that are not available to the public or other members. We employ mechanisms to protect data within our walls. One such mechanism is a firewall that protects our computer systems and your information. Firewalls are selective barriers that block access and allow only authorized traffic through.

 

We also use system and application logs to track all access. We review these logs periodically and investigate any anomalies or discrepancies.

 

Within our organization, we base access to member information on the sensitivity of the information, and our employee’s need-to-know. We authorize employees and representatives to use available member information for authorized business purposes only. Each employee receives a code of conduct that details our requirements for our employees when using this information. Disregard of these requirements may result in disciplinary action up to and including termination.

Your Obligations

You agree to use the Services only for lawful purposes. You agree not to interrupt or attempt to interrupt the operation of the Services in any way. Any conduct by you that, in our sole discretion, restricts, inhibits, or interferes with the ability of any other user to enjoy the Services (including by means of hacking or defacing any portion of the Services, or by engaging in spamming, flooding, or other disruptive activities, including with respect to the servers or networks used to make the Services available) is prohibited. You are strictly prohibited from communicating on or through the Services any unlawful, harmful, offensive, threatening, abusive, libelous, harassing, defamatory, vulgar, obscene, profane, hateful, fraudulent, sexually explicit, racially, ethnically, or otherwise objectionable material of any sort, including, but not limited to, any material that encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any applicable local, state, national, or international law. We reserve the right to terminate or suspend your use of (including any access to) the Services, or parts of the Services, without notice, if we believe, in our sole discretion, that it is in violation of these terms, our requirements, or any applicable law, or it is harmful to our interests or the interests, including intellectual property or other rights, of another user or any other third party, including any of our partners, affiliates, sponsors, providers, licensors, or merchants.,

 

You must not post, transmit, or otherwise make available through or in connection with the Services any virus or other computer code, file, or program that is potentially harmful or invasive or intended to damage or hijack the operation of, or to monitor the use of, any hardware, software, or equipment.

 

You agree to provide true, accurate, current, and complete information in connection with the Services. It is your responsibility to maintain and promptly update this information to keep it true, accurate, current, and complete. If you provide any information that is fraudulent, untrue, inaccurate, incomplete, or not current, or we have reasonable grounds to suspect that such information is fraudulent, untrue, inaccurate, incomplete, or not current, we reserve the right to refuse any and all current and future use of the Services without notice.

 

You must respond promptly to all email and other correspondence from RxEOB®, including without limitation email and correspondence concerning complaints or concerns regarding your use of the Services.

You are responsible for obtaining, maintaining, and paying for all hardware, software, and all telecommunications and other services needed for you to use the Services.  YOU ARE SOLELY RESPONSIBLE FOR ANY FEE, COST OR EXPENSE THAT YOU INCUR TO ACCESS, DOWNLOAD, INSTALL AND/OR USE THE APP(S) OR THE SERVICES

 

If you have a complaint regarding the RxEOB® Service, the App, or any other service received by us, you may submit a complaint to us in writing at the following address: 2810 North Parham Rd, Suite 245, Henrico, VA 23294. You may also submit a complaint by sending an email to clientsupport@rxeob.com , or by calling our customer support line toll-free at 1-877-495-7356. We will investigate and determine the appropriate solution.

Protected Health Information

You acknowledge and agree that by using the App, information related to the prescriptions obtained through the App will be collected from affiliates that participate in your prescription fulfillment with RxEOB. Such information includes name identifiers, birth date, gender, zip code information, and prescription information. You acknowledge and agree that this information received by affiliates that participate with the App and subsequently disclosed to RxEOB® will be used for the administration of the RxWallet®. RxEOB.Com® does not sell such information to any third parties. RxEOB.Com® itself is not a Covered Entity under the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). However, some of the information received from health care providers, health plans or health care clearinghouses (collectively, “Covered Entities”) is information that may constitute protected health information (“PHI”) under HIPAA, which is information created or received by a health care provider, health plan, or health care clearinghouse relating to the past, present, or future physical or mental health or condition of an individual, the provision of health care to an individual, or the past, present, or future payment for the provision of health care to an individual that identifies or can be used to identify an individual. In accordance with RxEOB’s Business Associate obligations under HIPAA to Covered Entities, RxEOB.Com® will keep confidential and safeguard any PHI RxEOB receives or collects, and not disclose PHI except as set forth the privacy policy incorporated here.

Indemnification

By entering into these Terms of Use and using the Services, you agree that you shall defend, indemnify and hold RxEOB®, its licensors and their respective parent organizations, subsidiaries, affiliates, officers, directors, members, employees, attorneys and agents harmless from and against any and all claims, costs, damages, losses, liabilities and expenses (including attorneys’ fees and costs) arising out of or in connection with: (a) your violation or breach of any term of these Terms of Use or any applicable law or regulation, (b) your violation of any rights of any third party, (c) any unauthorized use of the Services, or (d) your negligence or willful misconduct.in.
